Introduction

If you made an application under the Regularisation of Long Term Undocumented Migrant Scheme, and received a letter from Immigration Service Delivery (ISD) refusing your application for permission under the Scheme, you can appeal this decision. The deadline for submitting an appeal is 30 working days from the date of your initial refusal letter.

Your refusal letter from ISD will state the reason(s) why your initial application was unsuccessful. You should address these reasons in your appeal form, explaining why you do not agree with the ISD decision, and provide documentary evidence in support of your statements.

You must have received a letter refusing you permission under the Regularisation of Long Term Undocumented Migrant scheme.

How can I appeal an unsuccessful application under the Regularisation of Long Term Undocumented Migrants Scheme?

Please follow these steps to appeal an unsuccessful application:

  • Submit your individual appeal within 30 working days from the date of your initial refusal letter

  • All family members must submit an individual appeal application

  • Complete the online appeal form and submit it with all the required documentation

  • All appeals must be submitted online

  • Appeals will not be accepted by post

  • Please remember to submit your appeal online, as ISD will not process appeals that are saved in draft on your ISD online account

Is there a fee?

No, there is no fee payable to submit an appeal.

What documents must I submit as part of my appeal?

Your refusal letter from ISD will state the reason(s) why your initial application was unsuccessful. You must submit documentary evidence in support of your statements on your appeal form, explaining why you do not agree with the ISD decision.

Please do not resubmit any documentation which you submitted as part of your initial application.

Once you submit your appeal online, you will not be able to amend this form and add additional documentation. Therefore, you must submit all documentation at the same time as your appeal form.

It is vitally important that you complete the appeal form fully and correctly and that you submit it and all of the documentation required, within 30 working days from the date of your initial refusal letter.

What happens if my appeal is successful?

If your appeal is successful we will send you a letter by post telling you:

  • You will receive a letter granting you permission on a stamp 4 basis for two years. (This is a very important letter, so please keep it somewhere safe)

  • If you are over the age of 16 and live in Dublin, Kildare, Meath, Wicklow, Cork or Limerick the Registration Office is at 13-14 Burgh Quay, Dublin 2.     register at your local Garda National Immigration Bureau (GNIB) office. This could be your local Garda station.

  • If you are between the ages of 16 and 18, you will need a parent or guardian to accompany you to your registration appointment

  • All subsequent renewals are to be made online.

What happens if my appeal is unsuccessful?

We will advise you in writing that your appeal has been unsuccessful, and the reasons why, by post. The following will apply:

  • The appeal decision is final and cannot be appealed further

  • If you have another open application with ISD, this application will continue to be processed and a decision issued on that application in due course

  • If you do not have another open application within ISD or a permission to be in the State,  you will receive (if you have not previously received) a notice under Section 3 of the Immigration Act, 1999 (as amended) that the Minister intends to make a deportation order against you. You should respond to the notice within the timeframe specified in the notice. Under the ‘Section 3’ process, you have the option to make submissions to the Minister as to why a deportation order should not be made against you. The Minister is obliged to consider any relevant Constitutional and Convention rights, such as family life rights and private life rights, before making a decision on whether to make a deportation order

  • If your appeal is unsuccessful and you have an existing deportation order, your existing deportation order remains valid and you will be required to leave the State. You may wish to seek legal advice on making an application to revoke your deportation order under Section 3(11) of the Immigration Act, 1999 (as amended), especially if there are changed circumstances since the deportation order against you was made.
